Terms of Service

These terms govern your use of smartifyai.com and of the internal assistant application operated bySmartify AI (“SmartifyAI,” “we,” “us”), referred to below as the Application. By using either, you agree to them. If you do not agree, do not use them.

The website

This site describes our services and lets you get in touch. Content on it is provided for general information. It is not professional, legal, or financial advice, and it does not create a client relationship. Engagements are governed by a separate written agreement, and where that agreement conflicts with these terms, that agreement controls.

The Application

The Application is internal software. It is made available only to authorized operators of SmartifyAI for managing their own work accounts. It is not sold, licensed, or offered to the public, and no general right of access is granted by these terms.

If you are an authorized operator, you agree to the following.

• Connect only accounts you own or are authorized to use.
• Keep your credentials secure and do not share your access with anyone else.
• Use the Application lawfully, and not to send unsolicited bulk mail, harass anyone, or misrepresent who you are.
• Review what the Application drafts before it is sent. You are responsible for messages sent from your account.
• Respect the confidentiality obligations you owe to your own clients and employers when choosing what to connect.

We may suspend or withdraw access at any time, particularly where we believe an account is being misused or a security issue requires it.

Automated output

The Application uses artificial intelligence to summarize, draft, and organize. Output can be incomplete or wrong. It is a draft for a person to check, never a substitute for that person’s judgment. Do not rely on it for decisions with legal, financial, medical, or safety consequences without independent review.

Your content

You keep all rights to the content in your connected accounts. We claim no ownership of it. We handle it as described in our Privacy Policy, and we use it only to perform the tasks you ask for.

Our content

The text, design, graphics, and software on this site belong to SmartifyAI or our licensors. You may read and share the site, but you may not copy it wholesale, resell it, or present it as your own.

Third-party services

The Application connects to services operated by others, including Google. Your use of those services remains subject to their own terms, and we are not responsible for how they behave, change, or become unavailable.

No warranty

The site and the Application are provided “as is,” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that either will be uninterrupted, timely, secure, or error-free.

Limitation of liability

To the fullest extent the law allows, SmartifyAI is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of your use of the site or the Application. Our total liability for any claim relating to them is limited to one hundred United States dollars (US$100) or the amount you paid us for the service giving rise to the claim in the twelve months before it arose, whichever is greater. Nothing here limits liability that cannot be limited under applicable law.

Indemnity

You agree to indemnify SmartifyAI against claims, losses, and reasonable legal costs arising from your misuse of the site or the Application, or from your breach of these terms.

Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. The state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction over any dispute, and you consent to that jurisdiction.

Changes

We may update these terms. The date at the top of this page shows when they last changed, and continued use after a change means you accept the revised terms.
